Why It's Legal
California state law only allows medical marijuana growers in most counties to possess 6 flowering OR 12 vegetative plants. If you have a single plant over this limit, you are at risk of arrest. Our service matches growers with California nonprofit cannabis collectives -- allowing growers to legally cultivate under the collective's umbrella of medical patients. And your monthly membership dues help your collective provide discounted services to low-income patients.
How is it legal? For collectives, the plant limit is PER member. This means that authorized collective growers may possess plants and processed flowers for other members. Our service allows you to do just that! In exchange for your donation to the collective, you receive cultivation authorization covering your grow. (Your monetary donation is all you provide to the collective.) Simply choose how many plants you would like to grow and your collective will assign patients to cover you. It's that simple.
The Nitty Gritty
PROPOSITION 215, the California Compassionate Use Act, was enacted by the voters and took effect on Nov. 6, 1996 as California Health & Safety Code 11362.5. The law makes it legal for patients and their designated primary caregivers to possess and cultivate marijuana for their personal medical use given the recommendation or approval of a California-licensed physician.
SB420, a legislative statute, went into effect on January 1, 2004 as California H&SC 11362.7-.83. This law broadens Prop. 215 to transportation and other offenses in certain circumstances; allows patients to form medical cultivation “collectives” or “cooperatives”; and establishes a voluntary state ID card system run through county health departments. SB 420 also establishes guidelines or limits as to how much patients can possess and cultivate. Collectives are allowed by law to grow enough medicine for each member of the collective. And as an authorized member/grower, you will be permitted to legally grow medicine on behalf of other collective members.
